The H-2A visa program allows U.S. employers to address this labour shortage by hiring temporary foreign workers. This program ensures that U.S. farmers have access to a reliable and skilled workforce that can help them meet the demand for their products.

The H-2A temporary agricultural program allows agricultural employers who anticipate a shortage of domestic workers to bring non-immigrant foreign workers to the U.S. to perform agricultural labour or services of a temporary or seasonal nature.
Domestic worker shortages could be because there are not sufficient US workers who are able, willing, and qualified and who will be available at the time and place needed to perform the labour or services.

To qualify for the program, a US employer must first offer a temporary or seasonal job to a US worker and demonstrate that no US workers are able, willing, qualified, and available at the time and place needed, to perform the labour or services involved in the petition.

1. The Department of Labor issues the H-2 labour certifications and ensures employers comply with labour laws.

What Are the Potential Consequences of a Visa Overstay? If your legal stay has expired and you remain in the United States, you will lose your lawful status and begin to build what is known as an 'unlawful presence.
If over 10% of non-immigrants from one country overstay, the entire country can be found ineligible for the H2A visa program.

H-2A petitions may only be approved for citizens of countries that the secretary of homeland security has designated, with the concurrence of the secretary of state, as eligible to participate in the H-2A program.
The Department of Homeland Security publishes the list of eligible H-2A countries in a Federal Register Notice. Designation of eligible countries is valid for one year from publication.

The clientele Farm Recruit USA associates with are more than 90% large row crop farmers, for whom the most important selection criteria are that you can start working with and be familiar with the type and size of their machinery with your arrival.
We can only place workers with extensive farm backgrounds and relevant experience who are familiar with manual labour, and willing to do it, which will be performed for 80% of the contract period.

Unfortunately, due to time and cost constraints, farmers cannot offer training. Most farmers are actively involved in the business and have day-to-day responsibilities requiring all their time. Training is not available even if you are a fast learner and a hardworking individual.

It is time-consuming and uneconomical. Employers/farmers pay the same rate for someone with all the farm experience.
Their main selection criteria, overriding various other factors, is someone with vast experience on the newest, high-tech, high-output North American farm machinery operated with various GPS self-steer systems.

Our farmers do not accept attendance certificates or presenter courses as applicable experience. Even a week or two will not swing the decision in favour of a candidate compared to other applicants with field experience.

We advise gaining more experience during the South African harvest and planting season with a prominent crop farmer running US-sized equipment.

Employers in the US will only consider you if you grew up on a farm where the same North American farm machinery is used, but they are hesitant to employ workers younger than 25.

Unfortunately, it is challenging for women to find work on the crop farms for which we recruit workers in the US.
Employers must provide separate accommodation for women, so they prefer hiring men. Because women compete against men in strenuous physical work, it is understandable that employers prefer men instead.

We at Farm Recruit USA have only a few farms with housing approvals to accommodate both sexes. With all positions taken by 2024 workers returning in 2025, married couples working for the same employer are about as scarce as hen’s teeth.

We've never received any requests from the farmers we recruit for documents or multimedia resumes. All the necessary information is included in our application form, with corresponding fields to be completed.
Employers, over the years, assisted us in building our application form in a format they prefer to provide them with the information they want.

We have never had an employer request a police clearance, so it is unnecessary to provide one.

The ideal time to submit your application would be towards the end of the year or early in the new year. If you have not been placed yet, please update your application at the end of the year using the link provided when you submitted your form. This will allow us to send it out as soon as the first requests start.

Guideline to use:
Take 75% of the hours on the offer, and multiply it by the contract period and per-hour pay rate to calculate the total (this is guaranteed). Any hour above this is a bonus.

To make your application for farm work in the USA easier, we compiled an online application form to gather all the information we need for a placement. Therefore, you do not need to submit a resume.
Minimum requirements to apply:
South African citizenship (not all countries are eligible for the H2A visa program).
Must be 18 years and older.
No criminal record.
Valid, undamaged passport (if you do not have a passport or it has expired, you can upload it later).
Funds to cover (consulate/visa fee, return flight & medical travel insurance).
Extensive experience operating modern North American farm equipment with GPS self-steer.
References from two previous employers regarding relevant experience.

Once you have submitted your application form online, you will receive an email confirming that we have received it, along with a unique application reference number that starts with FRU.
This number is specific to your profile and should be used for future correspondence regarding your application. Please save this email where you can find it in the future because it is the only place with the link where you can edit your application form.

We do not have an upper age limit as long as you are physically fit and capable of performing the necessary tasks. We have placed individuals in their 40s, 50s, and even 60s with farmers in the southern states.
Many employers are now setting the minimum age for applicants in their mid-twenties, due to historical experiences with young South African workers, which unfortunately now affects all applicants.

Process After Completing My Application Form

We will review your resume and conduct the necessary background checks.
When a farmer or US agent requests applicants, we will select candidates who meet their requirements and send them 4 to 6 resumes to review.
Once the farmer has made their selection, we will send you a formal employment offer that needs to be signed and returned to us.
As soon as we receive your acceptance, we will notify the farmer.

•We have designed our application form over several seasons with honest input from our farmers. Many of them feel comfortable extending an offer of employment to a candidate based solely on the application form. However, some farmers prefer to interview the candidates before deciding.

We suggest that our farmers use WhatsApp to communicate and schedule interviews. This app supports voice and video calls, making it a convenient option. Moreover, it is the most popular app in South Africa and is cost-effective. Please ensure that the WhatsApp number provided in your application can receive both WhatsApp messages and voice calls.

The answer is that there is no fixed time frame.
Depending on the availability of jobs, placement with a farmer can happen within a few days or may take a few weeks. Placement is mostly dependent on experience.

Process After Placement

This is the date when you submitted your application online using the DS160 form.

At this stage, your documents have been delivered to the consulate through DHL, but they have not yet updated their system to show that they have received them.

This is just a confirmation from the consulate that they have received your documents and have entered the details into their system.

At this stage, a caseworker will review your application to ensure you meet all the visa requirements. If there is any missing information or insufficient documentation, or if an in-person interview is required, the consulate will contact you.

This means that your visa has been approved, and the US embassy or consulate has issued your visa.
If your visa application has been approved, the consulate will issue your visa stamp. This stage means that your visa is almost ready, and you should receive it within a week to 10 days. If you don't receive anything, you can contact the consulate for an update.

A visa refusal under section 221(g) of the Immigration and Nationality Act (INA) means the applicant did not establish visa eligibility to the consular officer's satisfaction, as is required under U.S. law, specifically section 291 of the INA. The farmer is responsible for housing their workers on a H2A program.
The US State Department inspects the housing annually and requires the farmer to comply with specific requirements before obtaining H2A certification.

The agent ensures that all workers travel together to the same farm and coordinates their return flights to South Africa. She is also available 24/7 to assist workers with any travel changes.
We do not receive kickbacks from this service.

Social Security numbers (SSNs) are nine-digit numbers issued by the Social Security Administration (SSA). SSNs are assigned to U.S. citizens, permanent residents and eligible non-immigrant workers in the United States. (Source: Homeland Security, Social Security).

The nature of work that employees are expected to perform in the USA varies. You will receive a work agreement that sets the terms and conditions.
Manual labour:
It may include manual labour such as digging holes, cleaning silos, ditches, carts, combines, semi-trucks, or grain carts, laying poly pipes, spraying chemicals using backpack sprayers, repairing and changing worn-out tyres, as well as cleaning and washing machinery and workshops.
Some of these tasks, such as laying poly pipes, might require working in temperatures exceeding 40°C and high humidity. Therefore, it is important to be prepared and willing to perform any job the employer requires. other may be performed in bitterly cold and wet conditions.
I understand that you are curious about the nature of your job duties. While your visa class is for a “seasonal farm labourer”, it does not mean that you will exclusively operate equipment such as tractors, trucks, and combines. Your duties may include, but are not limited to:
Assisting with planting, tillage, irrigation, chemical or fertilizer application
Harvesting and delivering crops to packaging and/or processing facilities
Loading seed into planters properly and operating equipment to plant crops
Participating in irrigation activities, including laying pipe, setting up and operating irrigation equipment, and clearing and maintaining irrigation ditches
Building, constructing and maintaining levees, installing and removing levy gates, and putting in spillways
Using hand tools and equipment to repair, clean and maintain farm vehicles, machinery, specialized machinery, and agricultural equipment.

Yes. Federal wage statutes, such as the Fair Labor Standards Act, apply to these workers like any other worker. Additionally, a few states have enacted laws that require overtime pay for agricultural workers. H-2A employers must comply with all such applicable laws. The majority of States don’t have overtime.
In states that require the payment of overtime, employers manage time worked per period, and will rather employ more workers to keep all within the normal pay rate.

Because the H-2A visa program is for temporary or seasonal work, the visa issued to workers is also temporary, and workers are limited to the duration of the job listed on the temporary labour certification.

Suppose you overstay the end date of your authorized stay, as provided by the CBP officer at a port of entry or United States Citizenship and Immigration Services (USCIS). In that case, your visa will generally be automatically voided or cancelled, as explained above.

The minimum hours mentioned in the contract are applicable only if they are NOT met by the END of the season. There is no guarantee of minimum hours per week for this job.
Since the work depends on the weather, some weeks might have lower hours due to rain, while others might keep you busy all day, every day.

You are guaranteed 75% of the minimum hours per season.
For example,
Hours of work per week: 40-hour week
Period of contract: 30 weeks
The calculation follows 40 hours x 30 weeks = 1200 total hours;
75% guarantee:
75% of 1200 hours = 900 hours.
However, this guarantee is not applicable if you have already worked more than the minimum guaranteed hours during the season. Can only be handled at the end of the contract period.

If the worker's services are no longer required before the end of the contract (the date specified in the job order) for reasons beyond the employer's control and the fulfilment of the job order is impossible, the employer may terminate the job order with the approval of ETA’s Certifying Officer.

An example of a reason beyond the employer's control is an unforeseeable, catastrophic event (fire, weather, or another natural disaster or man-made event).

The employer must pay the three-fourths guarantee for the period between the first workday after the worker arrives at the place of employment and the date of the termination of the job order.

Yes. If the worker fails to work any hours the employer offers (up to a maximum of the number of hours listed in the job order for a workday), then the employer may still count the hours offered toward the three-fourths guarantee.
